Terms of Service
These Terms of Service ("Terms") govern your use of devocab.com (the "Service"), operated by Mehmet Ugur Kebir ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
devocab is a German vocabulary learning application using spaced repetition. It is offered as a freemium product:
- Free tier: A1 vocabulary, capped at 20 cards per day, local-only progress.
- Premium tier: A1–C1 vocabulary, unlimited study, cross-device sync, advanced statistics, JSON import/export, user synonym management.
2. Accounts
You must create an account to use most features. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at support@devocab.com if you suspect unauthorised use.
3. Subscriptions, Billing and Trial
Paid subscriptions are processed and billed by Paddle.com Market Limited ("Paddle"), acting as our Merchant of Record. Paddle handles all payment transactions, tax compliance, refunds, and invoicing.
- Pricing: as displayed on the pricing page at the time of subscription. Prices may change with prospective effect; existing subscriptions are billed at the rate locked in at purchase until renewal.
- Billing: monthly or annual, selected at checkout. Subscriptions auto-renew until cancelled.
- Free trial: 3 days. A valid payment method is required at signup. If you do not cancel before the trial ends, the subscription converts to paid automatically.
- Cancellation: anytime via "Manage Subscription" in your account settings (opens the Paddle customer portal). Cancellation takes effect at the end of the current period; Premium access continues until then.
4. Refunds
See the Refund Policy for details, including EU 14-day right of withdrawal.
5. Acceptable Use
You agree not to:
- Reverse-engineer or attempt to circumvent the Service's feature gates or quota mechanisms.
- Resell, redistribute, sublicense, or share account credentials.
- Use the Service for any unlawful purpose or to violate any third-party rights.
- Submit malicious content (user synonyms etc.).
- Bulk-extract, scrape, copy, or harvest the vocabulary database or any substantial part of it, whether manually or through automated means.
- Redistribute, publish, or otherwise make the vocabulary content (translations, example sentences, word lists) available to any third party or service, including as training data for machine-learning models.
6. Intellectual Property
The Service software, design, vocabulary curation, AI-generated synonyms, example sentences, and content (other than data you generate) are owned by us or licensed to us. The A1–B2 word lists are based on the publicly available official word lists published by the Goethe-Institut on goethe.de; the C1 list is our own selection compiled with reference to the Duden Standardwörterbuch. These official lists remain the property of their respective publishers; we claim no rights in them and use them only as a vocabulary reference. devocab is not affiliated with, endorsed by, sponsored by, or certified by the Goethe-Institut, Duden, telc, TestDaF, or any other examination or dictionary provider; all trademarks are the property of their respective owners (see the Impressum for the source list and full trademark notice).
Your user-generated content (study progress, accepted synonyms) remains yours. By using the Service you grant us a limited licence to store and process this data solely to deliver the Service.
The vocabulary database is proprietary and is licensed to you for personal study within the Service only. Premium vocabulary is delivered in individually watermarked copies that let us trace an unauthorised copy back to the originating account. Extracting or redistributing it is a material breach of these Terms and may result in immediate termination and legal action.
7. Availability and Changes
The Service is provided on a "best-effort" and "as available" basis. We do not offer a contractual service-level agreement (SLA), do not guarantee uninterrupted, error-free, or secure access, and do not guarantee any specific level of uptime, response time, or throughput. Planned maintenance, third-party outages (Supabase, Paddle, Cloudflare), or force majeure may interrupt access without notice. We may modify, suspend, or discontinue features at any time. Material changes that adversely affect paid subscribers will be announced by email or in-app with reasonable notice.
8. Disclaimer of Warranty — Content Accuracy and Learning Outcomes
The Service is an aid for self-study; it is not a substitute for formal instruction, an accredited course, or an examination preparation programme.
- No outcome guarantee. We make no representation or warranty, express or implied, that using the Service will result in any specific learning outcome, language proficiency level, passing grade, or examination result (including, without limitation, Goethe-Institut, telc, TestDaF, DSH, ÖSD, or any other certification). Examination success depends on factors entirely outside our control.
- Content may contain errors. The vocabulary, translations, and example sentences are curated with care but provided "as-is". Definitions, articles, plurals, grammar tags, and example sentences may contain errors, omissions, regionalisms, or outdated usage. The Service is not a dictionary, a translation tool, or a reference work for professional, medical, legal, or safety-critical purposes. Verify any term you intend to rely on against an authoritative source (Duden, Wahrig, Goethe-Institut materials).
- AI-assisted content. A portion of the synonyms, example sentences, and alternative translations was generated or refined with the assistance of large-language-model AI tools (e.g. Anthropic Claude) and subsequently reviewed. AI output is statistical and may contain inaccuracies, hallucinations, false friends, or culturally inappropriate phrasing that human review did not catch. By using the Service you acknowledge these characteristics of AI-assisted educational content and accept that you will exercise independent judgement before acting on it.
- User-submitted synonyms. Accepted-answer synonyms you add are stored on your account for your own study and are not curated or verified by us.
If you find a content error, please report it to support@devocab.com so we can correct it for everyone.
9. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including (without limitation) loss of study progress, failed examinations, missed deadlines, lost opportunities, lost data, or loss of profit. Nothing in these Terms limits liability that cannot be excluded by mandatory law (gross negligence, wilful misconduct, personal injury, German Product Liability Act).
10. Termination
We may terminate or suspend your account for material breach of these Terms. Data export remains available for a reasonable period (at least 30 days) following termination via the JSON export feature.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain applicable.
For consumers: the place of jurisdiction is your statutory venue. For businesses: exclusive jurisdiction lies with the courts of Lindenberg im Allgäu, Germany.
12. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-app banner at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
